California Takes a Stand against Transnational Repression with SB 509, New Legislation to Strengthen Protections for Diaspora Communities Targeted by Foreign Governments
Sacramento, CA – To defend human rights and civil liberties, Senator Anna M. Caballero (D-Merced) has introduced SB 509, a critical measure to address the growing threat of transnational repression in California. Transnational repression refers to the efforts of foreign governments to intimidate, harass, threaten, or harm individuals living outside their home country, often targeting dissidents, activists, journalists, or marginalized communities. These actions can include digital surveillance, coercion, legal manipulation (such as misuse of INTERPOL notices), and even physical violence, undermining human rights and civil liberties in democratic societies. The bill ensures that law enforcement officers receive specialized training to identify and respond to the persecution of diaspora communities by foreign governments, reinforcing California’s commitment to justice and safety for all residents.
“At its core, SB 509 is about upholding the fundamental rights of freedom, safety and self-expression of diaspora communities. Too often, individuals who have fled persecution in their home countries, search for asylum and safety yet continue to face harassment, intimidation and threats—even here in California. By requiring the Office of Emergency Services (OES) and the Commission on Peace Officer Standards and Training (POST) to develop specialized training for law enforcement, this bill will equip officers to recognize, document, and respond to the growing threat posed by foreign governments targeting diaspora communities.” – said Senator Anna M. Caballero (D-Merced) “This measure strengthens our commitment to protecting vulnerable individuals and their families and ensures safety, justice, and freedom of expression for all, regardless of their background or country of origin.”
Transnational repression is a direct assault on civil liberties and human rights. Victims are often silenced out of fear for their safety or the safety of their families, undermining their right to free speech, association and political participation which are the cornerstone of our democracy and constitution. The psychological toll of this repression can be severe, leaving individuals in constant fear of retribution.
While existing federal protections address some aspects of transnational repression, local law enforcement agencies often lack the necessary training to recognize these threats and support affected communities. SB 509 fills this gap by requiring the Office of Emergency Services (OES) to collaborate with the Commission on Peace Officer Standards and Training (POST) to develop a specialized curriculum for law enforcement. This training will equip officers with the tools to document incidents, identify patterns of harassment, and provide appropriate resources to victims.
By taking this proactive approach, California can set a national precedent to ensure that those who have sought refuge in the state are not subjected to continued persecution.
